OUR PHILOSOPHY

WAGE AND HOUR (FLSA) HYPOTHETICAL

Suppose the ABC Manufacturing Company's regular payday is Friday, October 1.  ABC mails your paycheck fully intending for it to arrive at your home by October 1.  But, the check gets lost in the mail, or the check is delivered to a next-door neighbor who forgets about it and doesn't get it to you until four days later.

 

Question:  Did the employer violate the Fair Labor Standards Act with respect to your paycheck?
